ARTICLE 1 - Scope of application

These General Terms and Conditions of Sale (hereinafter referred to as "GTC") apply, without restriction or reservation, to all sales concluded by the Seller with non-professional buyers ("The Customers" or "The Customer") wishing to purchase the products offered for sale ("The Products") by the Seller on the website www.blondeetbruneenlayette.com. The Products offered for sale on the website are as follows:

  • Diaper bags and baby care accessories

The main characteristics of the Products and in particular the specifications, illustrations and indications of dimensions or capacity of the Products, are presented on the website www.blondeetbruneenlayette.com which the customer is required to read before ordering.

The choice and purchase of a Product is the sole responsibility of the Customer.

Product offers are subject to availability, as specified when placing the order.

These Terms and Conditions are accessible at any time on the website www.blondeetbruneenlayette.com and shall prevail over any other document.

The Customer declares that they have read and accepted these Terms and Conditions by ticking the box provided for this purpose before implementing the online ordering procedure on the website www.blondeetbruneenlayette.com.

Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.

In the case of an order to a country other than metropolitan France, the Customer is the importer of the Product(s) concerned.

For all Products shipped outside the European Union and French overseas territories, the price will be calculated excluding taxes automatically on the invoice.

Customs duties, local taxes, import duties, or state taxes may be applicable. These will be borne by and are the sole responsibility of the Client.

ARTICLE 2 - Price

The Products are supplied at the prices in effect on the website www.blondeetbruneenlayette.com, at the time the order is registered by the Seller.

Prices are expressed in Euros, excluding and including VAT.

The prices take into account any discounts that may be offered by the Seller on the website www.blondeetbruneenlayette.com.

These prices are fixed and non-revisable during their period of validity, but the Seller reserves the right, outside the period of validity, to change the prices at any time.

Prices do not include processing, shipping, transport and delivery fees, which are charged separately, under the conditions indicated on the website and calculated prior to placing the order.

The payment requested from the Customer corresponds to the total amount of the purchase, including these fees.

An invoice is issued by the Seller and given to the Customer upon delivery of the Products ordered.

ARTICLE 3 – Orders

It is up to the Customer to select the Products they wish to order on the website www.blondeetbruneenlayette.com.

Product offers are valid as long as they are visible on the website, subject to available stock.

The sale will only be considered valid after full payment of the price. It is the Client's responsibility to verify the accuracy of the order and to report any errors immediately.

Any order placed on the website www.blondeetbruneenlayette.com constitutes the formation of a distance contract between the Customer and the Seller.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to payment for a previous order.

The Customer will be able to track the progress of their order on the website.

ARTICLE 3 Bis - Customer Area - Account

In order to place an order, the Customer is invited to create an account (personal space).

To do this, he must register by filling in the form that will be offered to him at the time of his order and undertakes to provide truthful and accurate information concerning his civil status and contact details, including his email address.

The Client is responsible for updating the information provided. They are advised that they can modify it by logging into their account.

To access their personal account and order history, the Customer must log in using their username and password, which will be provided after registration and are strictly personal. The Customer is prohibited from disclosing this information. Otherwise, they will remain solely responsible for any use made of it.

The Customer may also request to unsubscribe by visiting the dedicated page in their personal account or by sending an email to: bebel@blondeetbruneenlayette.com. This will be effective within a reasonable timeframe.

In the event of non-compliance with the general terms and conditions of sale and/or use, the website www.blondeetbruneenlayette.com will have the option to suspend or even close a customer's account after a formal notice sent electronically has gone unheeded.

Any account deletion, for whatever reason, results in the complete and total deletion of all the Client's personal information.

The Seller shall not be liable for any event due to force majeure resulting in a malfunction of the site or server, and subject to any interruption or modification in the event of maintenance.

Creating an account implies acceptance of these general terms and conditions of sale.

ARTICLE 4 - Payment Terms

The price is paid via secure payment, according to the following terms:

  • payment by bank card
  • payment via PayPal
  • Pay in 2 or 3 installments with no fees with Alma
  • payment via Apple Pay
  • payment via ShopPay 

The price is payable in full by the Customer on the day the order is placed.

Payment data is exchanged in encrypted mode using the protocol defined by the approved payment provider involved in banking transactions carried out on the website www.blondeetbruneenlayette.com.

Payments made by the Customer will only be considered final after the Seller has effectively received the sums due.

The Seller will not be obliged to deliver the Products ordered by the Customer if the Customer does not pay the full price under the conditions indicated above.

ARTICLE 5 - Deliveries

The Products ordered by the Customer will be delivered in mainland France or in the following area(s):

European Union or World.

Deliveries are made within a maximum of 15 days to the address provided by the Customer when placing their order on the website.

Delivery consists of transferring physical possession or control of the Product to the Customer. Unless otherwise specified or in the event of unavailability of one or more Products, the Products ordered will be delivered in a single shipment.

The Seller undertakes to make its best efforts to deliver the products ordered by the Customer within the aforementioned timeframes. However, these timeframes are provided for informational purposes only.

If the ordered Products have not been delivered within 15 days of the estimated delivery date, for any reason other than force majeure or the Customer's own actions, the sale may be cancelled at the Customer's written request, in accordance with Articles L216-2, L216-3, and L241-4 of the French Consumer Code. The sums paid by the Customer will then be refunded within fourteen days of the date of cancellation, without any compensation or deductions.

In the event of a special request from the Customer concerning the packaging or transport conditions of the products ordered, duly accepted in writing by the Seller, the costs related thereto will be subject to a separate additional invoice, based on a quote previously accepted in writing by the Customer.

The Customer is required to check the condition of the delivered products. They have 14 days from the date of delivery to submit any claims by email, accompanied by all supporting documentation (including photos). After this period, and if these formalities have not been observed, the Products will be deemed compliant and free from any apparent defects, and no claim will be validly accepted by the Seller.

The Seller will reimburse or replace as soon as possible and at its own expense, the Products delivered whose defects of conformity or apparent or hidden defects have been duly proven by the Customer, under the conditions provided for in Articles L 217-4 et seq. of the Consumer Code and those provided for in these General Terms and Conditions.

The transfer of risk of loss or damage to the Products will only occur when the Customer takes physical possession of them. Therefore, the Products travel at the Seller's risk, except when the Customer has chosen the carrier. In this case, the risk is transferred upon delivery of the goods to the carrier.

1.1 Customized Products

Personalized products require additional preparation time. As such, the shipping time may be extended by 3 to 4 business days .

1.2 International Deliveries & Customs Fees

For any delivery to a country subject to customs fees, these remain entirely the responsibility of the end customer (recipient).

In accordance with international customs regulations, we are unable to know the exact amount of these fees in advance, as this depends in particular on:

  • of the order value,

  • customs regulations of the destination country,

  • of any applicable import taxes and duties.

If the customer refuses the package, the reshipping costs will be borne by the customer.

ARTICLE 6 - Transfer of Ownership

Ownership of the Seller's Products will only transfer upon full payment of the price by the Seller, regardless of the delivery date of said Products.

ARTICLE 7 - Right of withdrawal & return

According to the terms of Article L221-18 of the Consumer Code, "The consumer has a period of fourteen days to exercise his right of withdrawal from a contract concluded remotely, following telephone solicitation or off-premises sales, without having to justify his decision or bear any costs other than those provided for in Articles L. 221-23 to L. 221-25.

The period mentioned in the first paragraph runs from the day:

1° From the conclusion of the contract, for service contracts and those mentioned in Article L. 221-4;

2. From the date of receipt of the goods by the consumer or a third party, other than the carrier, designated by the consumer, for contracts for the sale of goods. For contracts concluded off-premises, the consumer may exercise their right of withdrawal from the date of conclusion of the contract.

In the case of an order for several goods delivered separately or in the case of an order for a good consisting of multiple lots or parts whose delivery is staggered over a defined period, the period runs from the receipt of the last good or lot or the last part.

For contracts providing for the regular delivery of goods over a defined period, the period begins upon receipt of the first item.

The right of withdrawal can be exercised online, using the attached online platform, also available on the website, or by any other unambiguous statement expressing the wish to withdraw.

Returns must be made in their original and complete condition (packaging, accessories, instructions, etc.) allowing for their resale as new, accompanied by the purchase invoice.

Damaged, soiled or incomplete products will not be accepted for return.

The return shipping costs remain the responsibility of the Customer.

The initial shipping costs are non-refundable.

The exchange (subject to availability) or refund will be made within 30 days of the Seller's receipt of the Products returned by the Customer under the conditions set out in this article.

2.1 Return period

You have 30 days from the date of order to return your items, excluding personalized products, which are neither returnable nor exchangeable.

2.2 Return conditions

The products must be returned:

  • with their original labels,

  • in suitable packaging,

  • accompanied by the delivery note or a separate piece of paper stating your name and order number.

Any item showing any sign of use, washing or a stain will not be accepted and will be automatically returned to the customer.
Any product whose label has been removed cannot be accepted.

2.3 Return Procedures
Option 1 – Credit or exchange (free return)

Returns are free.

After receiving and validating the return, a gift card corresponding to the value of the product will be sent by email.

Terms :

  • Valid only in metropolitan France.

  • limited to one free return per order and/or per person,

  • applicable only to products valued at over €35.

  • Gift card valid for 6 months.

When the Customer chooses the free return option, the refund is made exclusively in the form of a credit note (gift card) , valid on the entire site.
The gift card then constitutes an alternative form of reimbursement that is voluntarily accepted .
As such, it is final and cannot give rise to any monetary refund , even in the event of a further withdrawal.

In the event of the return of a product paid for in full or in part with a gift card, the corresponding amount is automatically credited back to the gift card , in accordance with Article L. 221-24 of the Consumer Code.

Option 2 – Refund

The return shipping costs are the responsibility of the customer.

After verification of the items, the refund will be made via the original payment method within a maximum of 10 days .

The initial delivery charges remain the responsibility of the customer and are not refundable.

2.4 Special situations
  • In the case of a promotional offer that includes a gift, the return will only be accepted if the gift is also returned. Otherwise, its retail value will be deducted from the refund.

  • Any parcel returned due to refusal or non-collection at a relay point will result in a refund minus a €5 fee corresponding to the return costs.

  • If a customer ultimately wishes to receive a refund after having benefited from a free return, a fee of €5 will be deducted from the refunded amount.

  • Any purchase paid for by gift card is refunded exclusively to that card (Shopify technical constraint).

  • For all returns from abroad (outside mainland France), return shipping costs remain the responsibility of the customer, even in the case of an exchange.

  • Discounted packs must be returned in their entirety.

  • Items from the "Archives" operation are not eligible for return or exchange.

ARTICLE 9 - Seller's Liability - Guarantees

The Products supplied by the Seller benefit from:

  • of the legal guarantee of conformity, for defective, damaged or faulty Products or Products not corresponding to the order,
  • of the legal guarantee against hidden defects arising from a flaw in materials, design or manufacturing affecting the delivered products and rendering them unfit for use,

Provisions relating to legal guarantees

Article L217-4 of the Consumer Code

"The seller is obligated to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was the seller's responsibility under the contract or was carried out under the seller's supervision."

Article L217-5 of the Consumer Code

"The property conforms to the contract:"

1° If it is suitable for the purpose usually expected of similar goods and, where applicable:

- if it corresponds to the description given by the seller and possesses the qualities that the seller presented to the buyer in the form of a sample or model;

- if it possesses the qualities that a buyer can legitimately expect, having regard to the public statements made by the seller, the producer or their representative, particularly in advertising or labelling;

2° Or if it possesses the characteristics defined by mutual agreement between the parties or is suitable for any special purpose sought by the buyer, which has been brought to the seller's attention and accepted by the latter.

Article L217-12 of the Consumer Code

"The action resulting from a lack of conformity is time-barred two years from the date of delivery of the goods."

Article 1641 of the Civil Code.

"The seller is bound by a warranty against hidden defects in the thing sold which render it unfit for its intended use, or which diminish that use to such an extent that the buyer would not have acquired it, or would have given only a lower price, if he had known of them."

Article 1648, paragraph 1 of the Civil Code

"The action resulting from latent defects must be brought by the buyer within two years of the discovery of the defect."

Article L217-16 of the Consumer Code.

"When the buyer requests the seller, during the term of the commercial warranty granted to them upon the purchase or repair of movable property, to carry out repairs covered by the warranty, any period of immobilization of at least seven days is added to the remaining term of the warranty. This period begins from the date of the buyer's request for intervention or the date the property in question is made available for repair, if this latter date is later than the request for intervention."

In order to assert its rights, the Customer must inform the Seller, in writing (email or letter), of the non-conformity of the Products or of the existence of hidden defects from the date of their discovery.

The Seller will refund, replace or repair Products or parts under warranty deemed non-compliant or defective.

Return shipping costs will be covered by the Seller.

Refunds, replacements, or repairs of Products deemed non-compliant or defective will be carried out as quickly as possible and no later than 30 days following the Seller's confirmation of the non-compliance or hidden defect. This refund may be issued by bank transfer or check.

The Seller shall not be held liable in the following cases:

  • non-compliance with the legislation of the country in which the products are delivered, which is the Client's responsibility to verify,
  • in case of misuse, use for professional purposes, negligence or lack of maintenance by the Customer, as well as in case of normal wear and tear of the Product, accident or force majeure.
  • The photographs and graphics presented on the site are not contractual and do not constitute a binding commitment on the part of the Seller.

The Seller's warranty is, in any event, limited to the replacement or refund of non-conforming or defective Products.

Our workshops in Marseille and Portugal do everything possible to offer quality products with meticulous finishes.

However, these are textile products requiring appropriate care (no prolonged exposure to the sun, seawater or pool water, nor to chemicals).

4.1 Warranty

Bags and accessories are guaranteed for 6 months from the date of purchase .

To take advantage of this offer, the customer must send an email to sav@blondeetbruneenlayette.com :

  • photos of the product in question

  • his full contact details.

The following are excluded from the warranty:

  • normal wear and tear,

  • negligence or accident,

  • failure to comply with maintenance instructions,

  • any misuse or inappropriate use.

Repaired items are returned within a maximum of 3 weeks (excluding August, the workshop's summer closure period).

4.2 Out of warranty

For any item not covered by the warranty, the customer can also contact customer service. A feasibility study will be carried out with our workshops, and a quote will be provided if a repair is possible.

ARTICLE 10 - Data Processing and Freedoms

In accordance with law 78-17 of 6 January 1978, it is noted that the personal data which is requested from the Customer is necessary for the processing of his order and the issuing of invoices, in particular.

This data may be communicated to the Seller's potential partners responsible for the execution, processing, management and payment of orders.

In accordance with applicable national and European regulations, the Client has a permanent right of access, modification, rectification and objection with regard to information concerning him/her.

This right can be exercised according to the terms described in the "legal notices" section of the website www.blondeetbruneenlayette.com.

ARTICLE 11 - Intellectual Property

The content of the website www.blondeetbruneenlayette.com is the property of the Seller and its partners and is protected by French and international laws relating to intellectual property.

Any reproduction, in whole or in part, of this content is strictly prohibited and may constitute an infringement of copyright.

ARTICLE 12 - Applicable Law - Language

These Terms and Conditions and the transactions arising therefrom are governed by and subject to French law.

These Terms and Conditions are written in French. If they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.


ARTICLE 13 - Disputes

For any complaints, please contact customer service at the Seller's postal or email address indicated in ARTICLE 1 of these Terms and Conditions.

The Client is informed that in any event, they may resort to conventional mediation, with existing sectoral mediation bodies or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute.

The Client is also informed that they can also use the Online Dispute Resolution (ODR) platform:

All disputes arising from purchase and sale transactions concluded under these Terms and Conditions, which have not been resolved amicably between the seller and the buyer or through mediation, shall be submitted to the competent courts under the conditions of common law.

In the event of a damaged or missing package, the customer must make specific reservations to the carrier (on the proof of delivery or directly to the relay point).

Without these reservations, no claim can be accepted, even if the following documents are provided:

  • photos of the package (interior and exterior)

  • photo of the label,

  • photo of the merchandise,

  • sales invoice.

Any dispute request must be submitted within 72 hours of receiving the package . After this period, no claim will be considered.

ARTICLE 14 – Products resulting from the “Archives” operation

Products from the "Archives" operation are offered at reduced prices.
Therefore, they are neither returnable nor exchangeable as part of any commercial gestures.
In accordance with applicable legal provisions, these products are subject to the right of withdrawal provided for in Article L221-18 of the Consumer Code.
If this right is exercised, the refund will be made exclusively in the form of a credit note (gift card), under the conditions defined in Article 8 of these General Terms and Conditions of Sale.
