ARTICLE 1 - Scope of application

These General Terms and Conditions of Sale (hereinafter "GTCS") apply, without restriction or reservation, to all sales concluded by the Seller with non-professional buyers ("The Clients or the Client"), wishing to acquire the products offered for sale ("The Products") by the Seller on the site www.blondeetbruneenlayette.com. The Products offered for sale on the site are as follows:

• Diaper bags and childcare accessories

The main characteristics of the Products and in particular the specifications, illustrations and indications of dimensions or capacity of the Products are presented on the site www.blondeetbruneenlayette.com, which the client is required to read before ordering.

The choice and purchase of a Product are the sole responsibility of the Client.

Product offers are subject to available stocks, as specified when placing the order.

These GTCS are accessible at any time on the site www.blondeetbruneenlayette.com and will prevail over any other document.

The Client declares having read these GTCS and accepted them by checking the box provided for this purpose before the implementation of the online ordering procedure of the site www.blondeetbruneenlayette.com.

Unless proven otherwise, the data recorded in the Seller's computer system constitute proof of all transactions concluded with the Client.

In case of an order to a country other than Metropolitan France, the Client is the importer of the Product(s) concerned.

For all Products shipped outside the European Union and DOM-TOM, the price will be calculated excluding taxes automatically on the invoice.

Customs duties or other local taxes or import duties or state taxes may be payable. They will be at the expense of and are the sole responsibility of the Client.

ARTICLE 2 - Price

The Products are supplied at the rates in effect appearing on the site www.blondeetbruneenlayette.com, at the time of the registration of the order by the Seller.

Prices are expressed in Euros, excluding tax and including tax.

The rates take into account any discounts that may be granted by the Seller on the site www.blondeetbruneenlayette.com.

These rates are firm and non-revisable during their validity period but the Seller reserves the right, outside the validity period, to modify the prices at any time.

The prices do not include processing, shipping, transport and delivery costs, which are billed as a supplement, under the conditions indicated on the site and calculated prior to placing the order.

The payment requested from the Client corresponds to the total amount of the purchase, including these costs.

An invoice is established by the Seller and given to the Client upon delivery of the ordered Products.

ARTICLE 3 – Orders

It is up to the Client to select on the site www.blondeetbruneenlayette.com the Products they wish to order.

Product offers are valid as long as they are visible on the site, within the limits of available stocks.

The sale will only be considered valid after full payment of the price. It is the Client's responsibility to verify the accuracy of the order and to immediately report any error.

Any order placed on the site www.blondeetbruneenlayette.com constitutes the formation of a distance contract concluded between the Client and the Seller.

The Seller reserves the right to cancel or refuse any order from a Client with whom there is a dispute relating to the payment of a previous order.

The Client will be able to track the progress of their order on the site.

ARTICLE 3 Bis - Customer Area - Account

In order to place an order, the Client is invited to create an account (personal space).

To do this, they must register by filling out the form that will be offered at the time of their order and undertake to provide truthful and accurate information concerning their civil status and contact details, in particular their email address.

The Client is responsible for updating the information provided. It is specified that they can modify it by connecting to their account.

To access their personal space and order history, the Client must identify themselves using their username and password which will be communicated to them after their registration and which are strictly personal. In this capacity, the Client refrains from any disclosure. Otherwise, they will remain solely responsible for the use that will be made of them.

The Client may also request their unsubscription by going to the dedicated page in their personal space or by sending an email to: bebel@blondeetbruneenlayette.com. This will be effective within a reasonable time.

In case of non-compliance with the general terms and conditions of sale and/or use, the site www.blondeetbruneenlayette.com will have the possibility to suspend or even close a client's account after a formal notice sent electronically has remained without effect.

Any deletion of an account, for whatever reason, results in the complete deletion of all personal information of the Client.

Any event due to a case of force majeure resulting in a malfunction of the site or server and subject to any interruption or modification in case of maintenance, does not engage the responsibility of the Seller.

Creating an account entails acceptance of these general terms and conditions of sale.

ARTICLE 4 - Payment conditions

The price is paid by secure payment, according to the following methods:

• payment by credit card
• payment by PayPal
• payment in 2 or 3 installments free of charge with Alma
• payment by Apple Pay
• payment by ShopPay 
containing:

• photos of the product concerned,

• full contact details.

Excluded from the warranty are:

• normal wear and tear,

• negligence or accident,

• failure to follow care instructions,

• any abusive or inappropriate use.

Repaired items are returned within a maximum period of 3 weeks (excluding August, the workshop's summer closure period).

4.2 Out of warranty

For any item out of warranty, the customer may also contact customer service. A feasibility study will be carried out with our workshops, and a quote will be offered if a repair is possible.

ARTICLE 10 - Data Protection

In accordance with Law 78-17 of January 6, 1978, it is recalled that the personal data requested from the Customer is necessary for the processing of their order and the issuing of invoices, in particular.

This data may be communicated to the Seller's potential partners responsible for the execution, processing, management, and payment of orders.

The Customer has, in accordance with current national and European regulations, a permanent right of access, modification, rectification, and objection regarding information concerning them.

This right may be exercised according to the procedures described in the "Legal Notices" section of the site www.blondeetbruneenlayette.com.

 

ARTICLE 11 - Intellectual Property

The content of the site www.blondeetbruneenlayette.com is the property of the Seller and its partners and is protected by French and international laws relating to intellectual property.

Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement offense.

 

ARTICLE 12 - Applicable Law - Language

These GTCs and the operations resulting from them are governed by and subject to French law.

These GTCs are written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.




ARTICLE 13 - Disputes

For any complaint, please contact customer service at the postal or email address of the Seller indicated in ARTICLE 1 of these GTCs.

The Customer is informed that they may, in any event, resort to conventional mediation, with existing sectoral mediation bodies or any alternative method of dispute resolution (conciliation, for example) in case of a dispute. 

The Customer is also informed that they may also use the Online Dispute Resolution (ODR) platform:

All disputes to which the purchase and sale operations concluded in application of these GTCs and which have not been the subject of an amicable settlement between the seller or through mediation will be submitted to the competent courts under common law conditions.

In the event of a damaged or missing package, the customer must imperatively issue explicit reservations to the carrier (on the proof of delivery or directly to the collection point).

Without these reservations, no claim can be accepted, even if the following documents are provided:

• photos of the package (inside and outside),

• photo of the label,

• photo of the merchandise,

• sales invoice.

Any dispute request must be transmitted within a maximum period of 72 hours after receipt of the package. After this period, no claim can be taken into account.

ARTICLE 14 – Products from the "Archives" sale

Products from the "Archives" sale are offered at a reduced price.
Due to their exclusive nature and limited quantities available, ARCHIVES items cannot be returned or exchanged, except in the event of a lack of conformity.
